SCDC Anti-Spam Policy

In this document, “SCDC,” “we,” “us,” and “our” mean S.H.A.R.E. Community Development Corp, a Texas corporation, together with its wholly owned subsidiaries and affiliated entities. SCDC may designate any wholly owned subsidiary or affiliated entity to perform its obligations, including to develop, hold title to, execute a purchase contract for, and convey a building. Doing so does not relieve SCDC of its obligations.

This page applies to sharecommunitydevelopmentcorp.com and scdctexas.com and to every related page, form, and online feature SCDC operates. The footer of scdctexas.com links to the copies of these policies hosted on sharecommunitydevelopmentcorp.com; those copies govern both websites.

SCDC maintains a zero-tolerance spam policy. Any person found using information contained in our systems or websites to send spam will be immediately cut off from access. If you know of or suspect a violation, email spamabuse@scdctexas.com.

What Is Spam?

Spam is unsolicited commercial email. We send marketing email only to people who have asked to receive it, consistent with accepted permission-based email practice.

Permission-Based Email

We do not send marketing email unless a person has completed an opt-in or web form expressing interest in our information, products, or services, or has otherwise directly and proactively requested it.

Pre-existing business relationship. A recipient has a pre-existing business relationship where they have made a purchase, requested information, responded to a questionnaire or survey, or had offline contact with us.

Consent. Consent means the recipient has been clearly and fully notified of the collection and use of their email address and has agreed before that collection and use.

We do not purchase, rent, harvest, or scrape email lists, and we do not send marketing email to addresses obtained that way.

Opt-Out / Unsubscribe

Every marketing email we send contains a working unsubscribe link, and you may stop marketing email from SCDC at any time. We may still send required transactional or relationship messages — for example, a reservation confirmation, an account or password change, or a legal notice.

Referring Parties, Investor-Purchasers, and Others Promoting SCDC

This section applies to anyone who promotes SCDC to others, including Investor-Purchasers, Declaration Partners, referring parties, contractors, and anyone who may receive a referral or testimonial reservation expansion. Read it before you email anyone about SCDC.

If you promote SCDC to others, you must not:

• send unsolicited commercial email, text messages, or direct messages promoting SCDC;
• use purchased, rented, harvested, or scraped contact lists;
• use false or misleading sender names, header information, or subject lines;
• send from an address or domain that suggests you are SCDC, or hold yourself out as an SCDC employee, agent, broker, or representative;
• fail to honor an opt-out request; or
• make any representation about SCDC, its buildings, pricing, financing, or returns beyond what appears in SCDC’s published materials.

Commercial email you send promoting SCDC must include a functioning opt-out mechanism, your own valid physical postal address, and accurate identification of you as the sender. You are responsible for your own compliance, and SCDC may withdraw any referral or testimonial reservation expansion, and terminate the relationship, for a violation of this section.

Referring parties and persons giving testimonials are not employees, agents, brokers, dealers, investment advisers, or representatives of SCDC, and are not authorized to make representations on SCDC’s behalf.

The Law (CAN-SPAM Act)

The federal CAN-SPAM Act of 2003, 15 U.S.C. § 7701 et seq., sets requirements for commercial email, including accurate header and subject information, a valid physical postal address, and a working opt-out mechanism. These requirements apply not only to messages SCDC sends, but to commercial messages sent by others promoting SCDC.

Changes to This Policy

This page may change over time; the current version is the one posted here. Please check back periodically, as no other notice of changes will be provided.

Reporting a Concern

To report spam or a suspected violation, email spamabuse@scdctexas.com. For general questions, email info@scdctexas.com.

Disputes

Any dispute arising out of or relating to this page or your use of SCDC’s websites is governed by the dispute resolution provisions of the SCDC Website Terms of Use, which provide for a sixty (60) day informal resolution period followed by final and binding individual arbitration seated in Houston, Harris County, Texas, administered by the American Arbitration Association under its Commercial Arbitration Rules, governed by the Federal Arbitration Act. Those provisions waive trial by jury and waive class, collective, and representative proceedings.
